SOME WORDS DON’T BELONG IN A LIFE INSURANCE AD
Colorado’s Division of Insurance regulates life insurance advertising under Regulation 4-1-2, and it counts web pages, illustrations and “lead-generating devices of all kinds” as advertising, whether the insurer, an agent or a third party wrote them. The rules are specific. Ads “shall be truthful and not misleading in fact or by implication.” Words like “investment,” “savings plan,” “retirement plan,” “risk-free,” “safe” and “secure” cannot be used in a way that tends to mislead. An ad cannot emphasize the investment or tax features of a policy until it reads like something other than life insurance, it has to name the insurer, and “All advertisements, regardless of the writer, created or presented, shall be the responsibility of the insurer whose policies are advertised.” The rule follows the NAIC model, which holds the producer who created the ad responsible as well.
IUL adds a second layer. Regulation 4-1-8 bars an illustration from implying that non-guaranteed elements are guaranteed, and the actuarial guideline known as AG 49-A caps the rates an IUL illustration can show. FINRA calls indexed universal life “generally not considered a security,” and the ad still cannot talk like a brokerage statement. We write IUL ads around protection, flexibility and the review call, keep illustrated numbers out of the ad entirely, and write them so the carrier whose name is on them can sign off.
